All Judges Are Political - Except When They Are Not: Acceptable Hypocrisies and the Rule of Law (The Cultural Lives of Law)

Review

"Judicial authority is not in grave danger, at least in the terms that some alarmists imagine. In conversation with mainstream approaches to judicial practice, this remarkably original work contends that law's deceits sustain order and moderate conflict, all the while sustaining hierarchy. A major accomplishment." (Michael W. McCann University of Washington)"Bybee offers a truly fresh and important response to one of the most important questions in the cultural study of law: how can law sustain its legitimacy in the face of the understanding that it is essentially political? Arguing that law's hypocrisy actually strengthens it, Bybee makes a connection to courtesy that is really quite ingenious and illuminating. This is a wonderful new vehicle for understanding how courts work." (Austin Sarat Amherst College)"Between costly partisan judicial elections and a Supreme Court that appears frozen in an ideological 5-4 split, there has never been a more apt time to answer conclusively the question of whether judges are apolitical oracles or ideological politicians. Bybee's answer―they are both―sounds at first like a discomfiting one. But in this fascinating book he shows that the courts' very survival in fact rests on the white lie of this fundamental tension." (Dahlia Lithwick, Senior Editor Slate.com)"In using courtesy to account for the current state of our legal system, Bybee offers a fresh take on debates over judicial legitimacy and legal realism. Rejecting the contention that the public is simply confused, he presents an original answer to the puzzle of the public's paradoxical perceptions of the judiciary. The pull of his explanation and the unconventional but commonsense appeal of his account are engaging and provocative." (Helena Silverstein Law and Social Inquiry)"All Judges Are Political―Except When They Are Not successfully points out the conflicting roles that judges fill and demonstrates that these roles do not intrinsically compromise legal legitimacy. In the course of achieving this goal, Bybee uses substantive sources and unique comparisons to present intriguing ideas and theories. I recommend the book for anyone with an interest in the subject matter who does not mind a distinctly scholarly approach. The book would make a great addition to collegiate and law school libraries." (Jeff McGowan Law Library Journal)

Bybee finds an ingenious theory to solve the intractable problem of wayward judging. The public is aware that judges are bound to be impartial, and at the same time it suspects that many often are not. The fact may be that judges are often bias and hypocritical in that they appear sound impartial in citing law and principles when the decisions were made on other reasons. Bybee recommends that we impose courtesy as a habit so that even judges who have political agendas are compelled to achieve neutral means that make their decisions acceptable. Bybee thinks that courtesy is the method that best compels them to achieve this. Whether it works is a matter of debate. As another reviewer points out, we should not settle for less than the ideal of impartiality when insisting that judges uphold the rule of law. Bybee's thesis might work, but how do we convince the judges?

Writing of John Maynard Keynes's General Theory, Henry Hazlitt once opined that the book contained much that was true, and much that was original. Unfortunately, the parts that were true were not original, and the parts that were original were not true. A similar criticism could be leveled at Keith J. Bybee's new book, All Judges Are Political - Except When They Are Not.Bybee's twofold thesis is that (1) judges decide cases based on their personal ideological preferences, but conceal this with rhetoric about being bound by the rule of law; and (2) we should be happy about that, because this sort of hypocrisy is the glue that holds a civil society together. As to the first point, there's no disputing the general truth of Bybee's proposition, because it is uncontroversial. Lots of studies, over many years, have shown that many appellate decisions can be predicted or explained simply by reference to the political party with which judges are affiliated. There's nothing really new here, because Bybee doesn't dig deeply enough to get to the interesting part. Why do some judges subordinate their political views better than others, once they're on the bench? Are judges whose political views are in the minority more likely to issue politically-based rulings, or less so? Why does the political affiliation of judges lose its explanatory power in certain types of cases - notably, those involving property rights?Regrettably, Bybee probes none of these questions. Instead, he draws an extended analogy between law and the rules of etiquette to ground the second part of his thesis - that judicial hypocrisy is actually a good thing, that strengthens our attachment to and support of the legal process. Where this reasoning goes astray is in its failure to distinguish between uniform codes of behavior applicable to all of us simply by virtue of our existence as social creatures, and the more stringent standards we place on individuals in positions of authority over us.Bybee may be correct that most Americans value the ideals of impartiality and principled behavior, but are too consumed by avarice and self-seeking to practice them. But it does not follow from this that "a legal system that gives everyone a chance to appear impartial and principled, without actually requiring them to be so, is a system that has broad appeal" (pp. 101-102).I may embrace the many little social hypocrisies I encounter every day: "Pleased to meet you" (you incredibly boorish dolt); "That pie was delicious" (quick, where's the bicarbonate?); "Your talk had me on the edge of my seat" (it was the only way I could keep from dozing off). But that does not mean I would welcome a similar degree of dissembling on the part of a judge who must determine whether I am liable for another person's injuries, or whether the Coastal Commission can claim my property for the state without paying for it.Expecting judges to meet their professional responsibilities impartially and in accordance with the requirements of law, to the best of their ability, is neither foolish nor naive. Everyone understands that the judicial profession as a whole does not always live up to those expectations, and in certain instances they may not even make a good pretense of doing so. But that does not mean we should be satisfied with less.

Now it is time to read about the real history that took place on that fateful day in November 1621. It was not initially called Thanksgiving nor was it a holiday. Those two happenings didn't take place until 1947 brought about by a legislation enacted by our President Harry Truman and ratified by our congress. Plus the impromptu feast back in 1621 lasted for three days. Over 90 Native Americans joined with the Puritans (or seperatists if you wish) for the feast. The English settlers, totaling only 52 after their first year at "Plimoth" never referred to themselves as Pilgrims. And there was never an extensive writing about this gathering in 1621. In a letter written in 1621, a total of 115 words described this harvest gathering and later became the basis for the holiday we celebrate today on the 4th Thursday of November, Thanksgiving. The 90 Indians who converged on the Plimoth Colony had nurtured this very land that the English took over just a year earlier for thousands of years. Indians did not believe that anyone could own land. It was simply provided by the great spirit to be used as long as you settled upon it. The Wampanoag Tribe had a history that dated back thousands of years on this very land. The English settlers had a history of less than a year and certainly had no legal or moral right to the land without bargaining for it with the Indians. The harvest gathering lasted for nearly 3 days, not the usual afternoon at Grannies and then back home with left over in tow. You will read about the fruit and vegetables and fowl and deer that were available at the harvest. Fish and shell fish were also abundant. Unfortunately there were no pumpkin pies, whip cream or cranberries at this feast. You will learn more about the Wampanoag People whose name means "People Of The First Light." . They derived this name from the fact that the sun rose each morning on the eastern shore of the Massachusetts' Colony. Much will be revealed about their language and the colonizing of the new world. Daily activities of both people will be discussed. The Indians were very curious about the habits of the English, and the English owe their first year's survival to their growing knowledge of growing corn that the Indians shared with them. Peace remained between the two nations until 1640 when the Indians broke the peace alliance. The fight for land became the key issue as the English population exploded in this territory and their greed for more land caused problems between the two.. The English even began selling the Indians into slavery to traders in the West Indes. With this story you must appreciate the good that took place between these two people and condemn the bad that both inflicted upon one another. But most importantly you will better understand what actually took place at this time and put to rest all the Hollywood exploitation of the facts just to make a good story that would sell movies and books. History must reflect the truth, and this book published by the National Geographic Society is a quality presentation of fact and visuals. This is a wonderful book that every American child should read or have read to them .History must be told in terms of the truth and should never be embellished in order to exploit others. It is only from the truth that we can help avoid common mistakes in the future. We should start our adventure of the beginning of this history with the truth. And you will be glad that you had th8is historically correct works for story telling and reference.

This book was recommended to me as an historically accurate portrayal of Thanksgiving. I've learned so much regarding the inaccuracies of my own education since I began college and it's incredibly sad. We've almost successfully erased indigenous Americans from this land and from the history books. When we do include them, we turn them into mythical, historical beings and ignore the bloody truth of how we, as settlers, treated them and continue to treat them. I don't want my son to have to wait until he's in his twenties to learn more accurate historical lessons. Not only is this book interesting to me as an adult, it is written in a way that is easy for children to understand, also. I love that the photographs are present-day reenactments with Wampanoag artisans, scholars, performers, & educators who work with the Wampanoag Indian Program at Plimoth Plantation. I wish our schools would present this information instead of dressing the kids up as "pilgrims" and "indians" each year and claiming that it's done to honor the first Thanksgiving. It's insulting & inaccurate.

I like the realistic photographs in this book. It is a 7.1 level Accelerated Reader book. There are 46 pages of text with glossy photographs on every other page. Each page has about three paragraphs of material. Each paragraph has 4 to 6 sentences. The story of Thanksgiving is more realistically portrayed in this book's text. It dispels the myths, and allows a more truthful story of what the feasting was about. It also shares the truth about disease on both sides (Natives and settlers).

Good information for those wanting to be more truthful about the Thanksgiving story. It could be organized and presented better maybe. My older son is a very good reader in second grade, but this isn’t really accessible to him. I needed to read and interpret the information, and it’s a little boring.

We all know the Christopher Columbus teaching we got in school is much more myth than truth. This takes that same type of truth seeking and applies it to what we know and what we don't about the First Thanksgiving myth.Includes recopies, includes lots of descriptions of daily life, and even a few events that likely inspired the thanksgiving myth.

I was really uncomfortable with how my child’s school taught the kids about Thanksgiving. This book is very informative, and I plan on giving it to the principal in hopes that they change their Thanksgiving curriculum going forward.

This is absolutely the best book available for kids to learn the truth about the events surrounding the coming of the Pilgrims to Plymouth and the relationships between them and the local people. Very balanced and honest, this book offers a respectful view of this time in native and U.S. history.

As a teacher, this book is great! But... I got it for my family hoping it would be something we could read as part of our Thanksgiving program. It was a bit lengthy so we just read bits and pieces. Overall, outstanding book... just want not quite what I was wanting for my needs.

I have just about every book on Homeopathic Cell Salts that has ever been written in English, and this is the best of all of them. I was having a major problem that had been getting worse over the past six years, and followed the regimen recommended in this book. It started to clear up a half hour later, and now a week later the problem is gone. I could not be more pleased. The next step was going to be dialysis, but now all future steps are good health and freedom.

This is an indispensible book, making the choice of cell salts easy for the user. It was surprising to learn how much the face is a map to health. One of the great benefits of using the inorganic salts is that besides restoring health, they can restore a look of youth and beauty. In just two days on the right salt, my husband's age spots, which were quite noticeable in the last year, are markedly vanishing. It might take longer for another person, but it is impressive. Redness, pimples, dark circles and bags under the eyes, drooping lids, enlarged pores, all of these and more can be dealt with using the cell salts. The research and writing of this book is much appreciated.

This is a large very nice book with glossy pages, and the pictures are very large so you can see everything. There are lots of explanations (indications). Dealing with cell salts seems somewhat overwhelming to start, since everything in the body is always tied to something else. But I feel good about getting it, to at least try and learn about my own body interactions. I know almost nothing about homeopathy, but this seems a very good book to do self experimentation with. To learn about homeopathy from scratch I would recommend "Homeopathy: Beyond Flat Earth" by I think Dooley to see if you want to get involved with it at all. Facial Diagnosis has a lot of quoting from Carey's books. I like the format they have of giving an overview of what the individual salt is all about and then giving the things it applies to. There is much overlapping in cell salts and that is probably the hard part for those that want to jump in.

It is a very interesting book. I tought was facinating all that information. I am a nurse and now when I look at patients face I can tell what cell salt that they are lacking and could be good for them. I even told my sister to get the book. she now knows exactely what she needs to improve her look and health. Realy enjoy it.

This book is so exciting! As a wellness consultant is a must! One of the best purchases and investments in my health and my clients health I made!

OK so I don't really have much to say about homeopathy, or cell salts, and the little bit of astrology and biblical stuff at the end of each chapter made my eyes roll, so you might say that I am the least likely person to be biased in favor of this book around. But my teenage daughter and I read it, literally AGOG. We had no idea that all these things it showed in faces represented a deficiency in something! And I'm apparently massively deficient in nearly everything, which explains why facially I look so lousy compared to what I used to. And most people are apparently deficient in at least something, given what it showed (well given the average health of our culture that's no surprise).I don't think I have been so fascinated by a book in a really long time. It isn't often I read something that has truly new, holy-crap-I-never-thought-of-that information in it (maybe I'm old and jaded) but this did.Apparently these are subtle and it can take a long time of regular dosing to gradually get the body replete again. Like several months. Perhaps up to two years for really severe spectrum cases. They don't cost much though, and they are easy to take (dissolve beneath tongue and they don't taste bad), and the Hyland company has 6x and 30x versions of each individual (of the 12) cell salts for high deficiencies as well.I have only been taking them a couple days so I can't speak to the cell salts but this review is of the book. I found it just amazing... we'll see how right it turns out to be. I recommend anyone who can afford a book take the trouble to read it. If even part of it is accurate it seems like it could make a huge difference in your health and life.

Read this along with The Zodiac and the Salts of Salvation by George Washington Carey to understand which 3 salts you will be specifically deficient your entire life time and understand it is based on the 12 signs of the Zodiac. Twelve zodiac signs comprise the entire calendar year. Gestation is 9 months, so your body will always be short 3 salts for those missing three months (12-9=3). However because the earth is so naturally mineral depleted now, you will find you are deficient in all 12 cell salts. This book provides pictures showing the major facial cell salt deficiencies locations and symptoms, but that is only your face. Reading The Zodiac and Salts of Salvation by George Washington Carey explains how cell salt deficiencies affect the rest of your body.

I really love this book. I learned about the facial diagnosis and what cell salts to take from this book. This is a must buy for anyone interested in cell salt minerals.

The Healing Wisdom of Mary Magdalene: Esoteric Secrets of the Fourth Gospel

Review

“Thank you! This book is a welcome gift for disciples of Mary Magdalene and Jesus. Illuminating texts from the Fourth Gospel, Jack Angelo reveals the perspective of ‘the woman who knew the All’--Mary Magdalene herself. Here at last, flowing from Jesus’s seven miracles, are Magdalene’s wisdom teachings to guide the pilgrim soul on the Way of the Heart.” (Margaret Starbird, author of The Woman with the Alabaster Jar and Mary Magdalene, Bride in Exile)“Jack Angelo has discovered a treasure chest to which the key has been lost for 2,000 years. In this important and fascinating book Mary Magdalene takes us into the eternal, living stream of her own consciousness and decodes for us the healing wisdom, hidden until now, in the part of the Fourth Gospel called ‘The Book of Signs.’ Angelo shows us how seven miracles of Jesus are intended to be a roadmap to transformation as the blessed couple both teach and model the way of total one-ness and heart-centered knowledge. Patriarchal blindness caused the message to be lost in part, but it still carries dynamic power to heal our planet and end the existential sickness that distorts much of Christian thinking. We come to realize that ‘the beginning is right now’ and creation is happening as we awaken to the words of Maryam, master teacher, beloved disciple, wife, and companion of Yeshua.” (Mary T. Beben, author of The Pleiadian House of Initiation)“The Healing Wisdom of Mary Magdalene is a rich and fascinating read. I could not put it down. Jack Angelo’s insights on the real meaning behind the miracle stories in the gospels are a treasure trove of wisdom much needed in the world today . . . a pleasure to read.” (Tricia McCannon, author of Return of the Divine Sophia and Jesus: The Explosive Story of the 30 Lost)

This was beautifully written by the author. I was impressed by the historical information that he included with his own interpretations. This book offers so much for those that are searching for the truth. I consider this book would as a life changer....

Finally a truly informative account of our Mary Magdalene. Awesome!

This is a wonderful read. It is filled with very interesting information.

The idea that the Gospel of John is actually a record of the oral teachings of Mary Magdalene is growing in popularity. More and more people are accepting the thought that she was an important figure in the early Christian movement, and may indeed have taught along side Jesus as an equal.A visit to a cave in Provence provided Jack Angelo with the experience of sensing Mary Magdalene’s presence and opened the door to the pursuit of her wisdom teachings. A lifelong seeker on the shamanic path, he combined his intuitive encounter with scholarly research in order to better understand her role in the early history of Christianity. In this book, Angelo not only recounts his pursuit of the real Mary Magdalene, he also takes readers through the Fourth Gospel, revealing the layers of wisdom which he has found within the text. In the last part of the book, he helps readers to connect with the lessons that are found there and explore them further on their own.It is an interesting treatise on both early Christianity and the resurgence of the feminine aspects of spirituality (heart-centered wisdom). It will be an especially valuable tool for anyone interested in subtle energy and the healing modalities associated with that energy.(InannaWorks.com received a free copy of this book.)

Some ideas seem to reflect PARTS of beliefs , and teachings. But I have been in contact with spirit type happenings ,all my life. These teachings ,, seem too "talked-over" Not enough "simple explanations".Definition is for > ( For each to determine)

Not what I expected.

inspired view and different take on the gospel
